Public Notice: Proposed Regulations, August 2010

The Virginia Marine Resources Commission invites public comment on the proposed amendments to regulations listed below. 

In accordance with Section 28.2-209 of the Code of Virginia, a public hearing on the proposed regulations will be held at 12:00 Noon, on Tuesday, August 24, 2010, at the Virginia Marine Resources Commission, 2600 Washington Avenue, Newport News, Virginia.  Written comments on the proposals should be mailed to Jack Travelstead, VMRC Fisheries Management Division, 2600 Washington Avenue, 3rd Floor, Newport News, Virginia 23607, by 5:00 p.m., Monday, August 23, 2010.  Copies of the proposed regulations may be reviewed, at the Commission, Monday through Thursday, 8:15 a.m. to 5:00 p.m. and Friday, 8:00 a.m. to 2:30 p.m. and may be obtained by calling the Commission at (757) 247-2248.

1)  Chapter 4VAC20-270- 10 et seq. "Pertaining to Crabbing".   

The Commission will consider an industry-based proposal to establish the lawful daily time period, for the commercial harvesting of crabs by crab pot or peeler pots, as 5 a.m. to 1 p.m., from September 1, 2010 through September 30, 2010.

Currently, it is unlawful for any person licensed to catch and sell crabs taken by crab pot or peeler pot to take and harvest crabs from any crab pot or peeler pot, or to retrieve, bait or set any crab pot or peeler pot, except during the lawful daily time period from 6 a.m. to 2 p.m. during the month of September.

The purpose of this proposed amendment to the regulation is to reduce waste of the crab resource that may result from unseasonably warm water conditions.
