July 11, 2002 COMMISSION ACTIONS

Agenda Items for the July 11, 2002 special Commission meeting are listed below with the Commission's actions in bold.

1. DAVID L. STEARNS. #99-0234-15. Consideration of a request by the Stearns' attorney that the Commission continue the review of the decision of the Norfolk Wetland Board Staff to approve the substitution of vinyl sheeting in place of wood sheeting for a bulkhead previously approved by the Board. The request for review is the result of an appeal filed by 25 or more freeholders. The Commission has scheduled the appeal for consideration at the July 23, 2002 meeting. The Stearns' attorney has requested the matter be continued pending a judicial determination. All parties concerned agreed to a continuance, the question was how long would the continuance be. The Commission voted, 7-0, to defer the agenda item until the Norfolk Circuit Judge has issued a ruling in the matter set before him by Stearns' attorney.

2. PROPOSED AMENDMENTS TO REGULATION 4 VAC 20-752-10 ET SEQ. to provide for technical changes to the expanded blue crab sanctuary in the Chesapeake Bay. The Commission heard an appeal by watermen from the Reedville area of the Northern Neck who were concerned that the expanded sanctuary in their area came too close to the shore and include a portion of shallow water not intended to be included. The Commission voted, 7-0, to make an adjustment the line off Smith Point.
